Terms of Service

1. Acceptance of Terms

By creating an account or using MedChart+ (the "App," "Service," or "we/us/our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App.

These Terms apply to all users of MedChart+, accessible at medchart.life and via the MedChart+ mobile application.

2. Description of Service

MedChart+ is a personal health tracking application that allows individuals to log, organize, and visualize their own health data, including symptoms, medications, measurements, and wearable device metrics. The App is intended for personal record-keeping only.

MedChart+ is not a medical device, clinical diagnostic tool, or electronic health record system as defined by the FDA or any other regulatory body. It is not designed or intended to diagnose, treat, cure, or prevent any disease or health condition.

3. Eligibility

You must be at least 13 years old to use MedChart+. By using the App, you represent that you meet this age requirement. If you are under 18, you represent that a parent or guardian has reviewed and agreed to these Terms on your behalf.

4. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to:

• Provide accurate registration information
• Keep your password secure and not share it with others
• Notify us immediately at privacy@medchart.life if you suspect unauthorized access
• Not create accounts for others without their knowledge and consent

The App supports up to five user profiles per account. Each profile's data is stored separately. You are responsible for all profiles created under your account.

5. Subscriptions & Billing

MedChart+ offers a premium subscription at $1.99 per month ("MedChart+ Premium"), billed through Stripe. By subscribing, you agree to the following:

• Auto-renewal: Your subscription renews automatically at the end of each billing period unless cancelled before the renewal date.
• Cancellation: You may cancel at any time through the App's Settings → Manage Subscription or by contacting us. Cancellation takes effect at the end of the current billing period; no partial refunds are issued.
• Free features: Core logging functionality remains available without a subscription. Premium features (connected device integrations, advanced export, etc.) require an active subscription.
• Price changes: We reserve the right to change subscription pricing. We will notify you at least 30 days before any price change takes effect.
• Refunds: All charges are generally non-refundable except where required by applicable law. If you believe a charge was made in error, contact us within 30 days at privacy@medchart.life.

Payment is processed by Stripe. By subscribing, you also agree to Stripe's Terms of Service.

6. Health Disclaimer

In an emergency, call your local emergency services (911 in the US) immediately. Do not use MedChart+ to communicate urgent health concerns.

The App is designed to help you organize and recall your own health observations. The accuracy and completeness of your health data depend entirely on what you enter. We make no representation that the data you log is accurate, complete, or suitable for any medical purpose.

7. Your Data & Content

You own the health data you enter into MedChart+. By using the Service, you grant us a limited, non-exclusive license to store, process, and transmit your data solely to provide the Service to you.

We do not sell your health data to third parties. See our Privacy Policy for full details on how your data is collected, stored, and protected.

You may export or delete your data at any time within the App. To permanently delete your account and all server-side data, contact privacy@medchart.life.

8. Prohibited Conduct

You agree not to:

• Use the App for any unlawful purpose or in violation of these Terms
• Attempt to gain unauthorized access to other users' accounts or data
• Reverse-engineer, decompile, or disassemble any part of the App
• Use automated scripts or bots to interact with the Service
• Transmit viruses, malware, or any code of a destructive nature
• Use the App to store or transmit protected health information (PHI) of other individuals without their explicit consent
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity

9. Intellectual Property

MedChart+ and all associated software, design, logos, text, and graphics are the property of MedChart+ and are protected by applicable intellectual property laws. These Terms do not grant you any right, title, or interest in the App beyond the limited license to use it as described herein.

You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.

10. Third-Party Services

MedChart+ integrates with third-party services including Stripe (payments) and optionally Oura Ring (wearable data). Your use of these integrations is subject to the respective providers' terms and privacy policies. We are not responsible for the availability, accuracy, or practices of any third-party service.

The App is hosted on Replit's infrastructure. See Replit's Privacy Policy for information about server-side data handling.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant the accuracy, completeness, or usefulness of any information provided through the Service.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MEDCHART+ AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, PERSONAL INJURY, OR PROPERTY DAMAGE ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) $10.00 USD.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for consequential or incidental damages. In such jurisdictions, our liability is limited to the greatest extent permitted by law.

13. Indemnification

You agree to indemnify and hold harmless MedChart+ and its operators from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to your use of the Service, your violation of these Terms, or your violation of any third-party rights.

14. Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, if we believe you have violated these Terms or if required to do so by law.

You may stop using the Service and delete your account at any time. Upon termination, your right to use the Service immediately ceases. Provisions of these Terms that by their nature should survive termination will survive.

15. Governing Law & Disputes

These Terms are governed by the laws of the United States. Any dispute arising out of or relating to these Terms or your use of the Service shall first be addressed through good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration under the American Arbitration Association's rules, conducted in English.

You agree that any claims will be brought on an individual basis and not as part of a class action.

16. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. If we make material changes, we will provide notice within the App or via the email address on your account.

Continued use of the Service after changes become effective constitutes your acceptance of the revised Terms.
